These Terms of Service ("Terms") govern your use of Swiftbooked ("we," "us," or "our"), an AI-powered lead response and booking automation service operated by Jordan Konieczny ("Swiftbooked") based in Edmonton, Alberta, Canada. By subscribing to or using Swiftbooked, you ("Client") agree to these Terms.

Swiftbooked provides an AI-powered SMS chatbot that automatically responds to missed calls and inbound messages on behalf of your business. The service includes:

2. Subscription and Payment

Swiftbooked is offered on a monthly subscription basis. Your first 30 days are free. After the trial period, you will be automatically charged the applicable plan rate (Essential: $199/month, Pro: $299/month) unless you cancel before the trial ends.

Payments are processed securely through Stripe. We do not store your credit card information. All fees are in Canadian dollars and are non-refundable except as required by law.

We reserve the right to change pricing with 30 days' written notice to your registered email address.

3. Cancellation

You may cancel your subscription at any time through your client portal or by contacting us. Cancellation takes effect at the end of your current billing cycle. No partial-month refunds are issued.

We may suspend or terminate your account immediately for violation of these Terms, non-payment, or misuse of the service.

4. Client Responsibilities

By using Swiftbooked, you agree to:

You are responsible for all activity under your account. You are also responsible for configuring call forwarding on your business phone and disabling carrier voicemail as needed to enable the missed-call response feature.

Swiftbooked uses artificial intelligence to generate responses on behalf of your business. While we strive for accuracy, AI-generated responses may occasionally be incorrect, incomplete, or inappropriate. You acknowledge that:

Your use of Swiftbooked is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We process customer phone numbers and conversation content solely to operate the service on your behalf.

7. Intellectual Property

Swiftbooked and its software, design, and content are owned by Jordan Konieczny. We grant you a limited, non-exclusive license to use the service during your subscription. You may not copy, resell, or reverse-engineer any part of the service.

8. Limitation of Liability

To the maximum extent permitted by law, Swiftbooked shall not be liable for any indirect, incidental, special, or consequential damages, including lost revenue or business interruption, arising from your use of the service. Our total liability in any case shall not exceed the fees you paid in the three months preceding the claim.

9. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Edmonton, Alberta.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
